OSHA Recordkeeping
OSHA requires firms with 11 or more employees to record injuries during
the 2011 calendar year on the 300 log, and then post the summary form
300A for the period February 1 to April 30, 2012. Note that it is not
necessary to record cases where only first-aid was rendered. If there
were no injuries, form 300A must still be posted (indicating zero’s and
signed by an officer).
Form C-2, used to report workers’ compensation claims, is helpful when
completing the 300 log. The C-2 is also an allowable substitute for OSHA
form 301. Also note that the Standard Industrial Code (SIC) for
Electrical Contractors is 1731.
You must retain the OSHA 300 log and 300A summary, along with applicable
C-2’s, for a period of 5 years. After 5 years you may discard the OSHA
forms, but it is recommended that you keep a copy of all C-2 forms in
your files for at least 18 years.
Note that incidents involving one or more fatalities, or hospitalization
of 3 or more employees from the same incident must be reported within 8
hours to OSHA.
Annual Journal
The Association's 112th Annual Journal will soon be published.
The JOURNAL is a professionally designed magazine which includes timely
articles concerning the electrical construction industry, a recap of our
summer and winter meetings, along with ads and messages from our members
and industry partners. The Journal is widely distributed to our members
as well as suppliers, manufacturers, inspectors and related industry
groups.

WORKERS' COMPENSATION
RATES REVISED
Effective with renewal
policies October 1, 2011
The NY Compensation Rating Board has announced an
average "loss cost level" rate increase of 9.1% effective with
policies renewing October 1, 2011 and after. Changes to individual
classification codes
vary based upon industry experience. The NYS Assessment charge
will be increased from 18.1% of premium to 20.2%.
The rating system involves the
calculation of just the loss component of rates, and each industry
classification will have a state determined loss cost. Carrier
profit and overhead are no longer contained within the manual rates
calculated by the state, rather each carrier will file a "loss cost
multiplier". The loss cost rate, multiplied by the
loss cost multiplier will yield the total rate charged by the carrier.
Each carrier's final rates will vary based upon their approved
multiplier.
The new "Loss Cost" rate for Code 5190- Electrical Wiring is
5.49, a 8.3% increase from the current rate of 5.07. The "Loss Cost" rate for Code
5191- Low Voltage is 1.35, an increase of 6.3%.
For those who qualify for Payroll
Limitation, the weekly payroll "cap" of $1,109.75 will be revised to
$1,159.44 effective with renewals after October 1, 2011. The
Territory Differentials (which were minimal) will be eliminated.
Benefits for injured workers are
indexed to 2/3 of the average statewide weekly wage. The current weekly maximum benefit
for injured workers is
$772.96. For many years the weekly maximum was held constant at
$400.

SCHOLARSHIP WINNER ANNOUNCED
The NYSEC Scholarship Committee is always faced with the difficult task
of selecting just one recipient from among many talented and qualified
applicants-- this year being no exception.
For 2011, the Committee selected
Thomas Bittlemann of member firm Douglas Electrical Contracting, LLC in
East Northport, NY.
Mr. Bittlemann plans to attend the
Ohio State University in the fall.
The total award is $4,000 paid at $1,000 per year, and is open to the
children and grandchildren of management employees and owners.
